01About these terms
These terms and conditions (the “Terms”) govern your use of InspectorWho: the website at inspectorwho.com, the web application at beta.inspectorwho.com (and any domain it moves to), the InspectorWho mobile apps, and our emails (together, the “Service”).
The Service is provided by Early Tree Limited, a company registered in England and Wales under company number 14693946, with its registered office at 8 Oak Field, Brayton, Selby, North Yorkshire, YO8 9QZ, United Kingdom (“we”, “us”, “our”). You can contact us at support@inspectorwho.com.
By using the Service, or by creating an account, you agree to these Terms. They also include our community guidelines. Our privacy policy and cookie policy explain how we handle personal data. If you do not agree to these Terms, please do not use the Service.
If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf, and “you” includes that organisation.
02The Service
InspectorWho collects and analyses inspection reports published by Ofsted for England. It lets you search reports, settings and inspectors, see statistics and trends, follow inspectors and settings, receive alerts, read plain-English summaries, and take part in member ratings and discussion.
The Service is currently free. Parts of it are in beta, which means features may change, be added or be withdrawn, and the Service may sometimes be unavailable. We will try to give reasonable notice of significant changes, but we do not guarantee that the Service, or any feature, will always be available or uninterrupted.
03Your account
- You must be 18 or over to create an account.
- You must give accurate information, including your role, and keep it up to date. You may hold only one account.
- We sign you in with single-use links sent to your email address, or through a sign-in provider you choose. Keep access to your email account secure, because anyone who can read your email can sign in as you. Tell us straight away at support@inspectorwho.com if you think someone else has accessed your account.
- Your display name is shown to other members. It must not impersonate anyone, mislead others about who you are, or be offensive. We may change or remove a display name that breaks these rules.
- You are responsible for activity on your account.
04The information on InspectorWho
Please read this section carefully. InspectorWho is an independent analysis of published reports. It is not an official source, and it is not affiliated with, endorsed by or connected to Ofsted or the Department for Education.
- Inspection reports, grades and judgements are Ofsted's. We extract information from published reports automatically. We check it in several ways (see Data sources and corrections), but extraction can still be wrong or incomplete, reports can be withdrawn or amended by Ofsted, and some reports may be missing or late.
- Statistics about inspectors, settings, areas and groups are calculated from published reports. They describe patterns in the published record and depend on sample sizes and the mix of settings inspected. They are context, not a verdict on the conduct or competence of any individual, and must not be presented as such.
- Measures of tone, themes and writing style describe the language of reports. They say nothing about the correctness of an inspection judgement.
- AI-generated summaries and Deep insight answers may contain mistakes. Always check the original report, which we link to.
- Ratings and comments are the opinions of the members who posted them, not ours.
- Nothing on InspectorWho is legal, professional, educational or financial advice. Before relying on any information for an important decision, check the original Ofsted report and take appropriate advice.
If you find an error, please tell us using “Report a problem” in the app or by emailing support@inspectorwho.com.
05Acceptable use
You must not use the Service to:
- break the law, or encourage anyone else to;
- harass, threaten, intimidate or abuse anyone, including inspectors, providers, staff or other members;
- post defamatory, discriminatory, obscene or otherwise unlawful content, or content that breaks our community guidelines;
- identify, or attempt to identify, any child, any childminder or children's home whose identity is not published, or any person whose identity Ofsted has withheld;
- publish anyone's private information, such as home addresses, personal contact details or information about their private life;
- impersonate anyone or misrepresent your role or affiliation;
- scrape, crawl, copy or extract data in bulk, or use automated tools to access the Service, except search engine and AI crawlers that respect our robots rules, an AI assistant you connect to Deep insight with your own access token for your own use, or with our written permission;
- reproduce, republish, sell or build a competing product or database from the Service or its data;
- interfere with, overload or disrupt the Service, or attempt to bypass security, rate limits or access controls;
- upload viruses or other harmful code, or probe the Service for vulnerabilities without our permission; or
- send spam or unsolicited promotions.
If you find a security vulnerability, please report it responsibly to support@inspectorwho.com and give us reasonable time to fix it before disclosing it.
06Content you post
You are responsible for the ratings, comments and other content you post (“your content”). You confirm that your content is honest, reflects your genuine experience or opinion, complies with these Terms and our community guidelines, and does not infringe anyone's rights.
You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format and moderate your content for the purpose of operating, improving and promoting the Service. This licence ends when your content is deleted from the Service, except for copies we are required or permitted to keep (for example, for legal claims) and copies in backups, which are overwritten in the normal course.
We moderate content after it is posted. We may remove, hide or refuse any content, and suspend or close accounts, if we reasonably believe the content or account breaks these Terms, our community guidelines or the law, or creates a risk for us or others. We are not obliged to monitor content, but we act promptly on reports. How to report content, including complaints about defamation, is explained in our community guidelines.
07Intellectual property
Inspection reports and related information contain public sector information licensed under the Open Government Licence v3.0. Your rights in that information are set out in that licence, and nothing in these Terms limits them.
Everything else in the Service, including our software, design, text, graphics, logos, the InspectorWho name and detective mark, and the structure, selection and arrangement of our data, together with the statistics, analysis and other material we create, belongs to us or our licensors and is protected by copyright, database rights and trade mark law.
You may:
- use the Service for your own personal, professional or research purposes;
- quote or share individual facts, statistics, charts or screenshots, with a credit to “InspectorWho” and a link where possible; and
- link to any public page of the Service.
Anything beyond that, such as systematic extraction, republishing substantial parts of our data or analysis, or commercial reuse, needs our prior written permission. Contact support@inspectorwho.com.
08Emails and alerts
If you follow inspectors or settings, we will email you when relevant new reports are published. You can switch alerts off at any time on your Following page. We will also send essential service emails, such as sign-in links and important changes to your account or these Terms, which you cannot opt out of while you have an account. Alerts depend on Ofsted publishing reports and on email delivery, so we cannot guarantee they will arrive or be timely.
09Deep insight and access tokens
Deep insight is an AI assistant that answers questions from published inspection data. Its answers are generated automatically, can be incomplete or wrong, and are not professional advice. Check anything important against the original report before relying on it. Access is by request during early access, uses credits (see Deep insight credits and paid features), and may be limited or withdrawn, for example while it is in testing or if usage costs become too high.
- You may create personal access tokens to use Deep insight's tools from your own AI assistant. Tokens are for your own use: keep them secret, don't share or publish them, and revoke any token you think has been exposed. You are responsible for activity using your tokens.
- When you connect your own assistant, its provider processes your questions and the data returned under its own terms, and we are not responsible for what it does with them or for its answers.
- You must not use Deep insight, or any connected assistant, to try to identify or locate a private individual, to get around its limits or masking, or to extract data in bulk. We log the lookups it makes and may suspend access or revoke tokens if these rules are broken.
10Deep insight credits and paid features
The Service is free to use, apart from Deep insight, which runs on credits. When your early access is approved you receive free trial credits. Each answer uses credits according to the work it took, which reflects what it costs us to produce; the app shows your balance and what each answer used before you ask the next question. Answers that fail are not charged. When your credits run out you can ask us for more.
- If we offer credits or any other feature for payment, we will tell you the price, what you get and the terms that apply before you buy, and we will never charge you without your express agreement. Purchases in the mobile apps, if offered, are made through the app store under its terms.
- Credits are not money: they have no cash value, cannot be transferred or exchanged, and are only for use with Deep insight on your account. Free and trial credits may be changed or withdrawn. Credits you have paid for will not be withdrawn without a refund of their unused value, unless we close your account because you broke these Terms.
- Unused credits are lost if you delete your account.
- Your rights under consumer law, including to a refund for digital content that is faulty or not as described, are not affected.
Existing free features may be changed, but we will give reasonable notice before withdrawing or charging for a significant free feature you use.
11Mobile apps
We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use the InspectorWho mobile apps on devices you own or control, in line with these Terms and the rules of the app store you downloaded them from. Updates may be required to keep using the apps.
Additional terms for apps downloaded from the Apple App Store
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to the app.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app, such as your mobile network's terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you.
Apps downloaded from Google Play
Your use of apps downloaded from Google Play is also subject to the Google Play Terms of Service. Google is not responsible for the app.
12Suspending or ending your use
You can stop using the Service and delete your account at any time (see Delete your account).
We may suspend or close your account, or restrict features, if you seriously or repeatedly break these Terms, if we must do so by law, or to protect the Service, our members or others. Where reasonable, we will tell you why and give you an opportunity to respond. We may also stop providing the Service altogether, in which case we will give you reasonable notice where we can.
The sections on intellectual property, liability and general terms continue to apply after your use ends.
13Our responsibility to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights, including under the Consumer Rights Act 2015.
If you are a consumer
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you started using the Service. We are not responsible for loss or damage that is not foreseeable, or for business losses. Because the Service is free and is an analysis of published reports, you should check the original report before relying on it for any important decision.
If you use the Service for business
To the fullest extent permitted by law: the Service is provided “as is” and we exclude all implied conditions, warranties and terms; we are not liable for loss of profits, revenue, business, goodwill, data or anticipated savings, or for any indirect or consequential loss; and our total liability to you arising out of or in connection with the Service, whether in contract, tort (including negligence) or otherwise, is limited to £100.
Other websites and content
We are not responsible for websites we link to, including Ofsted's, or for content posted by members, except as required by law.
14Changes to these Terms
We may change these Terms from time to time, for example to reflect changes to the Service or the law. We will update the “last updated” date and, for significant changes, tell you by email or in the app at least 14 days before they take effect, unless the change is needed sooner for legal or security reasons. If you do not agree to the changes, you can delete your account. If you continue to use the Service after the changes take effect, the new Terms will apply.
15General
- We may transfer our rights and obligations under these Terms to another organisation, and will tell you if we do. You may not transfer yours.
- Except for Apple and its subsidiaries as described above, no one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
- If a court finds part of these Terms unlawful, the rest will continue in force.
- If we do not enforce our rights straight away, we can still enforce them later.
- These Terms, together with the documents they refer to, are the whole agreement between you and us about the Service.
- These Terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
